Tinubu disqualified? Court Gives Verdict on Suit Seeking to Nullify APC Candidate's Nomination

FCT, Abuja - A Federal High Court in Abuja has struck out a case seeking to nullify the candidature of Asiwaju Bola Ahmed Tinubu, the presidential flag bearer of the ruling All Progressives Congress (APC) for the 2023 general election.

Bayo Onanuga, director of media and publicity, APC Presidential Campaign Council (PCC), made this known in a statement on Wednesday, November 23, in Abuja, The Nation reported.

The statement indicates that the Action Peoples Party (APP) and others filed the case against the Independent National Electoral Commission (INEC) as the first defendant, Tinubu as the second, and APC as the third.

Bola Tinubu 2023: What the APP wanted

The APP and others had prayed the court to ask INEC to invalidate the nomination of Tinubu as the APC presidential candidate.

They alleged that Tinubu provided false information in his form EC9 submitted to INEC.

The APC's counsel, Babatunde Ogala, however, filed a notice of preliminary objection on the grounds that the suit was statute-barred, disclosed no cause of action and that the plaintiff had no locus.

Onanuga said Ogala argued that it was frivolous and a waste of the judiciary's time.

Court gives verdict

Legit.ng gathers that the APP and other plaintiffs did not show up when the matter came up for determination before Justice Emeka Nwite of the Federal High Court, Abuja, on Monday, November 21.

“Justice Nwite subsequently struck out the case for lack of diligent prosecution,” Onanuga said.

Earlier, Legit.ng reported that Tinubu's family called on Nigerians to dismiss the rumour surrounding the APC presidential hopeful's background, health and age.

According to the family, the APC presidential candidate is an original son of the Tinubu family in Lagos state.

The family also disclosed that the health of the former Lagos state governor is like that of other people other than 60, which is being well-managed.
