Why Tinubu Might Be Disqualified From Participating in 2023 Presidential Election

In what can be described as a stunning turn of events, the presidential candidate of the All Progressives Congress (APC) Bola Ahmed Tinubu might be disqualified if the courts uphold the judgement of a Federal High Court sitting in Abuja which nullified the nomination of Governor Isiaka Oyetola and his deputy governorship candidate, Benedict Alabi, for the 2022 Osun state governorship election.

According to the judgement by Justice Emeka Nwite Governor Mai Mala Buni who submitted their names to INEC violated the provisions of Section 183 of the Constitution of the Federal Republic of Nigeria and Section 82(3) of the Electoral Act 2022, Tribune Newspaper reports.

The court declared that Governor Mai Mala Buni acted in contravention of the provision of Section 183 of the Constitution when he held dual executive positions as the Governor of Yobe State and the Chairman of the National Caretaker Committee of APC. 

The provisions of Section 183 read in part:

“The Governor, shall not, during the period he holds office, holds any other executive office or paid employment in any capacity whatsoever.”

This means that all actions of Buni while in office as APC acting boss, stand invalidated. 

These actions include the conduct of the party’s elective national convention which gave birth to the current NWC, among others. 

This will ultimately invalidate Adamu’s NWC, which conducted the primary that produced Tinubu. A NWC which itself has been invalidated by Buni's actions.

The presidential candidate of the All Progressives Congress (APC) Bola Ahmed Tinubu has declared that he is hale and hearty.

Tinubu made this known in a video he posted on his Twitter page on Sunday, October 2.

Recall that many Nigerians especially opposition party members have been asking for his whereabouts since he travelled to London.

In another report, the presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, has taken to dancing to unveil his five-point recovery plan for Nigeria. With this, Atiku shows he is fit to govern Nigeria.

This follows criticism about his age from teeming Nigerian youths who are asking for more younger president for the nation.
