Edo APC crisis: Oshiomhole defeats Obaseki as court declines to grant ex parte order

- Oshiomhole has survived the first hurdle in the plan to remove him as APC national chairman

- The APC in Edo state claimed that Oshiomhole had been suspended

- Members of the party had also called for the removal of the former Edo governor

Legal moves to remove the national chairman of the ruling All Progressive Congress (APC), Adams Oshiomhole, on Thursday, January 23, failed before a high court of the Federal Capital Territory (FCT), in Jabi, Abuja, The Sun reports.

Legit.ng reports that the court rejected an ex parte application filed by Mustapha Salihu who is the national vice chairman, northeast of the ruling All Progressives Congress (APC), Anselm Ojezua, a factional chairman of the APC in Edo state, and others who are seeking to remove Oshiomhole from office.

The rift between Oshiomhole and Governor Obaseki who succeeded him as governor of Edo state heightened with a faction, led by the latter, calling for Oshiomhole's removal. They claimed had been suspended by the party in the state.

However, the move to get Oshiomhole out was frustrated when the court refused to grant the ex parte motion filed by Salihu, Ojezua and others.

Rather, Justice Danlami Zenchi ordered that the defendants (Oshiomhiole, APC and others) be put on notice before the motion is heard so as to ensure fair hearing in the matter.

In the motion ex parte filed by Oluwole Afolabi, the claimant’s counsel, Salihu, Ojezua and co had asked the court to stop Oshiomhole from parading himself as national chairman of the ruling party.

They also asked the Inspector General of Police, the director-general of the Department of State Services (DSS) not to allow the defendant access to the office of the national chairman pending the determination of the motion on notice.

The order followed a heated argument by Damien Dodo (SAN) who is counsel to the defendants. He expressed shock at the alleged attempts by the claimants to coerce the court to grant their prayers without serving the processes on the first and second defendants.

The matter was consequently adjourned to February 18, for hearing of the claimants’ application.

Meanwhile, Legit.ng had previously reported that the deputy governor of Edo state, Philip Shaibu, said he had risked the safety of his family members while he was trying to save Oshiomhole from being impeached both in his first and second administrations.
